Terms of Service

1. Acceptance of Terms

By registering for, logging into, or otherwise using Wizard's Castle: Shadows of Zot ("the Game") you confirm that you have read, understood, and agree to be bound by these Terms of Service as well as any referenced policies (including the Privacy Notice and Imprint). If you are acting on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts and Responsibilities

  • Provide accurate registration information and keep it updated.
  • Maintain the confidentiality of your login credentials and monitor account activity.
  • Accept full responsibility for all actions performed under your account.
  • Understand that we may suspend or terminate accounts that violate these terms, abuse the service, or compromise security.

3. Acceptable Use

The Game is intended for entertainment. You agree not to:

  • Interfere with or disrupt the service or servers.
  • Use bots, scripts, or automated tools to gain unfair advantages.
  • Exploit bugs or vulnerabilities — report them to us instead.
  • Misrepresent your identity or impersonate another person or organization.
  • Attempt to reverse engineer or access the source code of the platform.

4. Intellectual Property

We retain all rights, title, and interest in and to Wizard's Castle: Shadows of Zot, including software, artwork, game data, designs, trademarks, and logos. Your purchase of in-game items grants you a limited, non-exclusive, non-transferable license to use those items within the Game.

5. Service Availability

We strive to keep the Game highly available but do not guarantee uninterrupted access. Maintenance windows or technical issues may temporarily affect the platform. We are not liable for data loss; game progress is saved server-side but we recommend treating runs as ephemeral.

6. In-Game Purchases & Billing

6.1 Pricing & Payment

  • Pricing: Current prices are displayed in the in-game shop before purchase. Prices are stated in Euro (EUR) and include applicable VAT where required.
  • Payment Methods: We accept payments via Stripe (credit card, debit card, and other supported methods).
  • Order Confirmation: Upon successful payment you will receive a confirmation and the purchased items will appear in your pending deliveries.
  • Invoicing: Payment receipts are automatically generated by Stripe and sent to your registered email address.

6.2 Virtual Items

In-game purchases grant you virtual items (consumables, character slots, cosmetic features) that have no real-world monetary value. Virtual items:

  • Cannot be transferred, traded, or sold to other players.
  • Cannot be exchanged for real currency.
  • May be modified or rebalanced as part of ongoing game updates.
  • Remain tied to your account and cannot survive account deletion.

6.3 Refund Policy

Due to the digital and immediately accessible nature of in-game items, refunds are generally not available once items have been delivered to your account. However, if you experience technical issues that prevent you from using purchased items, please contact support at support@wizardscastle.de and we will work to resolve the issue or consider a refund on a case-by-case basis.

7. Right of Withdrawal (Widerrufsrecht) for Digital Services

7.1 Consent to Immediate Access

When you purchase in-game items, you explicitly request and consent to immediate delivery. By completing your purchase you acknowledge and agree that:

  • Purchased items are made available to you immediately upon payment confirmation.
  • By claiming or using any purchased item, performance of the digital service contract begins immediately.
  • You expressly waive your right of withdrawal once you begin using purchased items, in accordance with Article 16(m) of Directive 2011/83/EU.

7.2 No Withdrawal After Use

Because in-game items are digital goods delivered immediately and in full upon purchase, and because you have consented to immediate performance, the 14-day withdrawal period does not apply once you have claimed purchased items. If you have not yet claimed any purchased items, please contact support@wizardscastle.de within 14 days of purchase to request withdrawal.

7.3 Exception for Technical Defects

If purchased items do not function as described due to technical defects or errors on our side, you retain the right to request a remedy (repair or replacement of functionality) or, if that is not possible, a price reduction or refund under applicable warranty laws. Contact support immediately if you encounter such issues.

8. Anti-Cheat & Fair Play

Use of browser developer tools or console manipulation during gameplay is detected and may result in your scores being excluded from the leaderboard. We reserve the right to flag or suspend accounts engaged in cheating.

9. Liability

The service is provided "as is" without warranties of any kind. To the extent permitted by law we disclaim responsibility for indirect, incidental, or consequential damages arising from your use of the Game. Our total liability under these terms is limited to the amount you have paid for in-game purchases during the 12 months preceding the event giving rise to the claim.

10. Data Protection

Personal data is processed in accordance with our Privacy Notice.

11. Changes to These Terms

We may update these terms to reflect legal, technical, or business changes. If updates are material we will notify registered users via email or in-app notice. Continued use after the effective date constitutes acceptance.
